Due Diligence & Agency Representation

“We’re under contract…now what?” This course provides real world clarity on your role in the contract process- one of the greatest areas of liability and lack of value by clients.

We’ll delve into the different areas of due diligence outlined in a purchase contract, and help you understand who is responsible for what, and what the common areas are that many of us may not feel as comfortable about explaining to our clients (or truly understand for ourselves), including:

  • Title
  • Appraisal
  • Septic
  • Inspection (which/what do you recommend and what liability do you take as a broker here)
  • And more!

You’ll gain an understanding of what you’re required to disclose as material/latent defects vs. stigmatizing information, how we stay in our lane professionally and ethically, and how to reduce liability while simultaneously increasing value to our clients.

You’ll also gain strategies to walk clients through their respective obligations in the contract and how to avoid common mistakes. This approach ensures brokers can confidently reduce their risk and liability by encouraging thorough information gathering and investigation by their clients.

IMPORTANT! Attendance requirements: Live online course will be presented via ZOOM Meeting. The link to join the meeting will be sent in the confirmation email. Students will need a device with two-way video and audio capabilities and a (free) Zoom account. To verify attendance, students must keep their camera on for the duration of the course and respond to live polls. Clock hour credit will only be given to students with their camera on, who are present and visible on their camera during the course, and who participate in course polls/chat. Instructor: John Gillam is a 3rd generation real estate broker. He began teaching real estate courses in 2004 and found a passion for working with brokers to develop greater understanding of how they may better protect themselves and their clients through a stronger knowledge of their relationships, contracts and exploring broader options for their clients and knowing how to best communicate those options. He works with over 25 State and Local Realtor Associations in several states as an educator and consultant. John continues to be active with the Realtor organization, where, locally, he chaired the MLS Committee for 10 years, was a board member for a regional MLS for over 6 years and has twice received the Distinguished Service Award. John brings experience in general residential, farm ranch, resort, commercial as well as leasing and property management. John is also a Community Association Manager licensed instructor.
